Who these terms apply to
These terms apply when a winery owner or authorised representative claims, updates or purchases a listing on Winenot and accepts this version of the terms. By accepting, you confirm that you are authorised to act for and bind the winery or business identified in the request.
A Discover listing that Winenot creates from public business information does not, by itself, mean that the winery has accepted these terms or has a commercial relationship with Winenot.
Free Discover listings
Discover listings are free and do not expire. We may create them from public business information and may edit, correct, suspend or remove them to protect directory accuracy. Confirmed addresses, phone numbers, opening notes and directions may be displayed when available.
Paid Explore listings
Explore provides the features described on the Subscriptions page at the time the order is accepted, subject to any written order or invoice agreed with the winery. If there is a conflict, the accepted order applies to the commercial detail and these terms apply to everything else. Paid priority placement is clearly labelled as a paid or sponsored position where required. It does not guarantee a particular ranking, number of views, enquiries, bookings or sales.
Start date and payment
A paid term starts when the enhanced listing is published, unless we agree another date in writing. Prices are in New Zealand dollars. GST is added only if applicable. Payment is due on the invoice date and covers the full annual term.
Renewal and cancellation
Listings do not renew automatically unless automatic renewal is expressly agreed in writing. We will contact the winery before the term ends. A winery may decline renewal at any time before the next term begins. If a subscription is not renewed, the listing returns to Discover at the end of the current term.
Refunds
Because annual placement and publishing work begins when an enhanced listing goes live, payments are not normally refundable after publication. We will correct a material failure to provide an agreed feature and, if we cannot do so within a reasonable period, provide an appropriate partial or full refund. Nothing in these terms limits rights that cannot legally be excluded.
Founding Member offer
The first fifty approved founding wineries receive Explore free for twelve months from publication. The subsequent $299 NZD annual renewal price remains available while the subscription is continuous. GST is added only if applicable. Founding recognition records participation in the launch group and may remain if the listing later returns to Discover.
Submitted content
You confirm that listing information is accurate and that Winenot may publish supplied text, logos, photographs and video. You also confirm that you own the content or have permission to provide it and that publication will not infringe another person's rights. You retain ownership and grant Winenot a worldwide, non-exclusive, royalty-free licence to host, display, resize, crop, edit for style and accuracy, and promote the content in connection with the directory and the accepted listing service. The licence ends when the content is removed, except for backups, records required by law and campaign material already produced with your approval.
You may request removal or replacement of supplied content. Winenot may remove content where ownership is disputed or the content is misleading, unlawful, unsafe or inconsistent with our standards.
Updates and availability
Owner-submitted changes are reviewed before publication. Explore updates receive priority review and are normally processed within two working days after we receive complete, verifiable information. Complex, unclear or incomplete changes may take longer, and we will contact the winery when clarification is required. We do not promise uninterrupted availability. Wineries remain responsible for notifying us when hours, booking arrangements, offers or other important details change.
Performance information
Explore reporting is provided quarterly and may include profile views and clicks to booking, website, phone, social, offer or directions links. Figures are indicative, may exclude filtered traffic and do not guarantee sales or bookings. A click to an external booking service is not confirmation that a booking was completed.
Suspension and ending a listing
We may correct, suspend or remove a listing where information cannot be verified, payment is overdue, content infringes another person's rights, the winery breaches these terms, or publication creates a material legal, security or reputational risk. Where practicable, we will explain the issue and allow a reasonable opportunity to remedy it. Ending a paid listing does not remove payment obligations already incurred, but does not affect any non-excludable right to a remedy.
Liability and statutory rights
Neither party is liable to the other for indirect or consequential loss that was not reasonably foreseeable when the order was accepted. Nothing in these terms excludes or limits rights, remedies or liabilities that cannot lawfully be excluded, including under the Fair Trading Act 1986, Consumer Guarantees Act 1993 and Privacy Act 2020.
Privacy, changes and disputes
Personal information is handled under our Privacy Policy. We may update these terms for future claims, renewals or orders. We will give an affected paid winery reasonable notice of a material change during an existing term, and will not materially reduce an agreed paid service without an appropriate remedy. These terms are governed by New Zealand law. Please contact us first so we can try to resolve a concern in good faith.
