Advertising Policy

Clear standards for paid winery promotion.

This policy applies when Winenot accepts advertising, sponsored content, paid priority placement or a promotional campaign. The accepted campaign proposal, order or invoice and this policy form the agreement. If they conflict, the accepted order applies to campaign-specific details and this policy applies to everything else.

Advertising identification

Advertising must be obvious to its audience. Where commercial content would not otherwise be obvious, Winenot labels it "Sponsored", "Paid placement", "Advertising feature" or with another equally clear identifier. The label must be prominent when the audience first encounters the content and remain clear on mobile devices and when content is shared. "Featured" or a subscription badge is not used as the sole disclosure for advertiser-controlled editorial-style content.

Advertising standards

Advertisers and Winenot must comply with New Zealand law, the Advertising Standards Code and any applicable sector code. Alcohol advertising and promotion must comply with the Alcohol Advertising and Promotion Code, be prepared with a high standard of social responsibility, and be developed and placed to target adult audiences.

Advertising must not be misleading, target minors, encourage hazardous or excessive consumption, imply that alcohol creates social, sexual, sporting or professional success, depict drink-driving, or make unsupported health, environmental, comparative or performance claims.

Advertiser responsibilities

Campaign approval and editorial control

The accepted order should record the deliverables, channels, campaign period, price, approval contacts and any included revision rounds. Winenot may edit material for style, accessibility, accuracy, legal compliance and format. Advertiser approval of factual campaign material will be requested before publication where agreed, but Winenot retains final control over publication, labelling, placement and compliance.

Independent editorial coverage is not advertising merely because a winery is listed or has provided factual background. If an advertiser controls content directly or indirectly, or provides payment, free services or another benefit in return for coverage, Winenot will assess and label the content as advertising where required.

Payment, cancellation and refunds

Prices are in New Zealand dollars and GST is added only if applicable. Payment timing, campaign dates and cancellation rights are set out in the accepted order. Unless the order says otherwise, payment is due on the invoice date and publication work may begin once the order is accepted.

If an advertiser cancels after production has begun, Winenot may charge for reasonable work completed and non-recoverable committed costs. If Winenot cannot deliver a material agreed placement, we will offer a reasonable replacement, rescheduling, credit or refund. Nothing in this policy limits a right or remedy that cannot lawfully be excluded.

Content licence

The advertiser retains ownership of supplied content and grants Winenot a non-exclusive, royalty-free licence to host, format, reproduce and distribute it through the channels and period covered by the accepted campaign, including reasonable promotion of that campaign. The advertiser warrants that this use will not infringe another person's rights.

Performance and reporting

Any audience estimate is indicative unless expressly guaranteed in the accepted order. Winenot may report page views and link clicks, but a click does not prove a completed booking or sale. Personal information is handled under our Privacy Policy.

Refusal, correction and removal

Winenot may refuse, pause, correct or remove advertising that is unlawful, misleading, unsafe, unsubstantiated, technically harmful, inconsistent with this policy or likely to damage audience trust. Where practicable, we will explain the concern and allow a reasonable opportunity to correct it.

Liability and statutory rights

Neither party is liable for indirect or consequential loss that was not reasonably foreseeable when the campaign was accepted. Nothing excludes or limits rights, remedies or liabilities that cannot lawfully be excluded, including under the Fair Trading Act 1986, Consumer Guarantees Act 1993 and Privacy Act 2020.

Changes, disputes and governing law

We may update this policy for future campaigns. A material change does not alter an accepted campaign unless agreed or legally required. The parties will first try to resolve concerns in good faith. This policy is governed by New Zealand law and the New Zealand courts have non-exclusive jurisdiction.
